Online Contest Rules & Regulations: Legal Disclaimer
As part of Best Balms marketing strategies, the company may promote giveaways and other promotional activities where internet based customers have the ability to win prizes as stipulated in the Free Stuff section of the web site.
The following are the general rules governing any contest and promotions initiated and sponsored by Best Balms Corporation. Unless modified to fit certain promotional strategies, the following rules shall apply:
1. Officers, employees, and employee-volunteers of Best Balms and their immediate families are not eligible to participate. Further, any former Officer, employee and employee-volunteers of Best Balms Corporation or any of its subsidiaries is prohibited from qualifying for and/or winning a prize of any value until 24 consecutive months has passed since the last day of their employment with Best Balms Corporation.
2. Members of all forms of media (including but not limited to TV, Radio, Online and newspaper) are ineligible to win any prize.
3. The decision of Best Balms Corporation in verifying and confirming winners will be final. Best Balms Corporation shall reserve the right to discontinue on-going promotions and contests as it deems necessary.
4. Contest winners must be residents of the United States of America. No exceptions! Also, all contest winners must be thirteen years of age or older.
5. Prizes are non-transferable. Best Balms Corporation reserves the right to substitute prizes if the prizes promised may become unavailable during the duration of the promotion. The alternate prize may be of equal or greater value than the original prize. Non-cash prizes are not convertible to cash.
6. Taxes may be due for certain prizes awarded by Best Balms Corporation. It is the responsibility of the winners to pay necessary and applicable taxes due on these prizes. Winners of prizes valued at $600.00 or more shall be asked to complete IRS Form W-9, Request for Taxpayer Identification Number and Certification. Winners who win prizes valued at a total of $600.00 during a calendar year shall be sent Form 1099-MISC. This IRS reporting form shall reflect the suggested total value of the prizes won by a single winner during the calendar year. The suggested total value of the prizes may not be the value subject to income taxes.
7. Certain winners maybe be required to sign a release and authorize Best Balms Corporation and it’s web site to use winners’ name in future promotions and contests. Winners shall also authorize Best Balms Corporation to be able to put on the web site their names & city, state of residence as a form of testimonial to be used strictly for promotional purposes only.
8. Prizes that are unclaimed within three months after the end of the contest period as stipulated in the Free Stuff promotional information listed above shall be forfeited.
9. Participants may win only once during a six month period. Winners are ineligible to participate and win a prize until three months from the date of their last win. For major prizes with a value of $600 or more, winner must wait one full calendar year before winning a contest on the Best Balm’s web site. These limitations also apply to family and/or household members for both winning and qualifications for prizes. Only one qualifier/winner per family or household per contest.
10. Due to the coverage of Best Balms Corporation’s web site nationwide, contests may be void where prohibited.
11. An internet purchase is necessary to participate in any contest initiated and/or sponsored by Best Balms Corporation
12. A copy of these rules may be obtained by sending a stamped, self-addressed envelope to Best Balms Corporate address at #133 E Main Street, Elmsford, NY 10523.
13. These rules are subject to change or modification at any time by Best Balms Corporation
14.) The date that this particular promotion will run is from February 8, 2009 to December 31, 2012. Any additional promotions will be listed separately.
15.) Free Stuff giveaway is a random promotion and is based upon the sales of the various balm products whereby the internet customers will have the chance to purchase the required quantity needed to be eligible. It is the sole discretion of the Best Balms Corporation to extend this promotion after the ending date of December 31, 2012.
